Terms of Service (ToS)

These Terms of Service (hereinafter: ToS) govern the use of the gerenda.studio cloud-based 3D modelling, drawing and quote generation software (hereinafter: Service). The Service is provided by Norbert Hőgyes EV. (registered seat: 5530, Vésztő Szabadság utca 6., Hungary). By registering an account, the User accepts these ToS.

gerenda.studio is currently in an open Beta phase. The purpose of the service is to support the 3D modeling of roof structures, to generate drawings from the models, and to prepare quotes. The Service is a modeling, visualization, and drawing tool; it is not a structural engineering or statics tool, and it does not replace the work of a qualified structural engineer. During the beta period, the Service is provided "as-is", and registration and usage are free.

The User is responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. In case of unauthorized use, the User must immediately notify the Provider.

The gerenda.studio software, its source code, and all related intellectual property are owned by the Provider. The User is granted a non-exclusive, non-transferable right to use the Service for the term of the contract.

The projects, 3D models, and drawings created by the User remain the User's property. By using the Service, the User grants the Provider a non-exclusive, royalty-free license to use the technical model and usage data (e.g., model geometry, dimensions, generated drawings and other outputs, feature usage) - in anonymized or aggregated form, and excluding the personal data of the User's own clients - for the purpose of operating, securing, testing, and further developing the Service. This right remains in effect during and after the beta period. Personal data recorded in the quote module is processed exclusively under the Data Processing Agreement (Section 6) and is never used for the Provider's own development purposes.

The Provider assumes no responsibility for the accuracy of 3D models made with the software, the drawings and other outputs generated from them, and quotes. The generated documents are for informational purposes only.

The Service does not perform any structural or load-bearing (statics) calculation and does not verify that a model or drawing is structurally sound. The software carries out no strength, load, or safety check: the User may enter any parameters, including physically or structurally impossible ones (for example, 1×1 cm rafters over a 10-metre span), and the Service will still generate models and drawings from them without any warning. The output therefore never constitutes a statement, guarantee, or certification that the model, the drawing, the cross-sections, or the dimensions are structurally adequate or safe to build.

It is the User's sole and exclusive responsibility to verify the correctness of all cross-sections, spans, dimensions, and structural requirements, and to involve a qualified structural engineer, before using any output for actual construction or for quoting to their clients. The Provider is not liable for damages arising from possible software errors in the beta version, or from models or drawings that are structurally inadequate or otherwise unfit for construction. This limitation does not affect liability that cannot be excluded under applicable law (e.g., for damage caused intentionally or by gross negligence, or for injury to life or health).

If the User inputs personal data of third parties (e.g., their own clients) into the Service (especially name, address, contact info on quotes), the User is considered the Data Controller and the Provider is the Data Processor under the GDPR regarding such data.

The Provider as Data Processor undertakes to:

• process the data exclusively for the purpose of providing the Service, according to the User's instructions, and never for its own purposes;
• ensure the protection of data with appropriate technical and organizational measures (e.g., encrypted connection, secure cloud storage);
• ensure that persons authorized to process the data are bound by confidentiality;
• delete the data upon termination of the contract or at the User's request.

The Provider is entitled to unilaterally amend these ToS (e.g., due to changes in the service or the legal environment). The Provider notifies registered Users of any material changes in advance by email. If the User does not agree with the changes, they may delete their account; continued use of the Service after the changes take effect constitutes acceptance of the amended ToS.

The User may delete their account at any time. The Provider reserves the right to suspend or delete the account without prior notice in case of abuse or violation of these ToS.

These ToS and the use of the Service are governed by Hungarian law. In case of any dispute, the Hungarian courts shall have jurisdiction.
